snap-bootstrap from snapd 2.59.3 is not booting on non-UEFI systems

Bug Description

A regression was introduced by https://github.com/snapcore/snapd/commit/444e5c1a6a415449fb147dffc28f2b954e35063d for non-UEFI systems so if a kernel is built with a snap-bootstrap with this change, it is possible that it won't boot depending on race conditions.
