No HDMI audio and crashes at startup

Bug Description

I have installed Kubuntu 13.04 in my media center, and the HDMI audio from my GeForce GTX 550 doesn't work with it. It used to work with 12.04 LTS.

I can see the card with aplay -l

It's card 1 device 7. However it won't be detected by pulseaudio or Phonon, and it won't play any sounds even if I disable pulseaudio.

Also, I'm having crashes sometimes at the splash screen, at startup. When it happens, I get a black screen and can't see anything anymore.

I have attached a dmesg of a crash.

As you can see, the crashes are HDMI related (RIP: 0010:[<ffffffffa02d2820>] [<ffffffffa02d2820>] patch_generic_hdmi+0xe0/0x550 [snd_hda_codec_hdmi]).

What is broken here?
How can I get my HDMI audio working and stop the crashes?

This is pretty much a kernel issue which most likely is to happen with Nvidia graphics card and with nvidia proprietary drivers.
If you are using linux kernel 3.8.0-19.29 or 3.8.0-18.28, try earlier kernels like 3.8.0-17.27.
Booting failure is known to be connected with this issue.

This may also be a duplicate of the bug 1169761.

I have installed kernel 3.9 and it seems to fix it all. I have HDMI audio again, and no crashes so far.
The problem is kernel 3.8 .

Attempting to play through alsa:

aplay -D plughw:0,3 /usr/share/sounds/alsa/Front_Center.wav
aplay: main:682: audio open error: No such device

Upgraded kernel from 3.8 to v3.9-rc8-raring and can confirm that the problem is fixed.

02:00.0 VGA compatible controller: Advanced Micro Devices [AMD] nee ATI Park [Mobility Radeon HD 5430]

Can’t remember if there was a crash, but when kernel was upgraded from linux-image-3.8.0-18-generic to linux-image-3.8.0-19-generic (or perhaps 17->18) in 13.04 beta, it went broken. It used to work with the prior kernels of 13.04 beta and even alpha.

The only way I could fix it was an upgrade to 3.9.0-030900rc8-generic.
