Upgraded to 3.8.8 and HDMI audio is working fine.

If using the NVIDIA downloaded drivers with Raring and the 3.8.8 kernel, you may need to:
export IGNORE_CC_MISMATCH=1
or else it may complain of a GCC mismatch.
